Terms of Service

1. Eligibility & Accounts

You must be at least 18 years old and have the legal authority to enter into these Terms. You are responsible for maintaining accurate account information, safeguarding authentication credentials, and promptly notifying us of any unauthorized use. You may not share your account with others unless expressly permitted in writing.

2. Use of the Chrome Extension

The extension may request permissions necessary to capture demos, screenshots, and contextual data solely for the features you initiate. You must use the extension in compliance with all applicable laws, Chrome Web Store policies, and these Terms. You may not reverse engineer, modify, or distribute the extension except as explicitly allowed by open-source licenses that accompany specific components.

3. User Content

You retain ownership of content you capture, upload, or otherwise create through the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive license to host, process, transmit, and display it as needed to operate the Services. You represent that you have the necessary rights to submit User Content and that it does not violate any law or third-party rights. You are solely responsible for obtaining consent when capturing personal or sensitive information.

4. Prohibited Conduct

• Using the Services for unlawful, defamatory, or fraudulent purposes.
• Attempting to gain unauthorized access to systems or data belonging to Demo Capture or others.
• Uploading malicious code, interfering with service stability, or bypassing security controls.
• Collecting or storing personal data about others without consent, including regulated categories.
• Reselling, sublicensing, or otherwise exploiting the Services for commercial gain without authorization.

5. Subscription & Fees

Certain features may require a paid subscription. Fees, billing cycles, and cancellation terms will be communicated at the time of purchase. By subscribing you authorize us or our payment processor to charge the applicable fees. You may cancel future renewals at any time; amounts already paid are non-refundable unless required by law.

6. Intellectual Property

We retain all rights, title, and interest in the Services, including software, documentation, logos, and trademarks. Except for the limited rights granted in these Terms, no license is granted to you. Any feedback or suggestions you provide may be used by us without restriction or obligation to you.

7. Third-Party Services

The Services may integrate with or link to third-party applications or websites. Those services are governed by separate terms and privacy policies, and we are not responsible for their content or practices. Your interactions with third parties are solely between you and the third party.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES. YOU USE THE SERVICES AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEMO CAPTURE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold Demo Capture, its officers, employees, and partners harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or if doing so is necessary to protect the Services or other users. Upon termination, your right to use the Services will immediately cease, but sections intended to survive (including ownership, disclaimers, limitations of liability, and indemnification) will remain in effect.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes arising under these Terms will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, if changes are material, provide additional notice. Your continued use of the Services after the effective date of the updated Terms constitutes acceptance of the changes.
